it seems the theme was conflicting. Thanks for that.
Now, my second problem is this: my form consists of a post image with a title and a caption.

When the form is submitted it creates the post but without a title and the image isn't inserted into the post. Do I need to use the post title form to get the title or can I use the title of the image as the post title?

Also how do i get the image to insert. I obviously want my form to be as simple to use as possible for the visitor so if its just upload image, image title and image caption that would be ideal.

many thanks for any tips

Themes can cause problems with plugins, as can other plugins. I would suggest testing for theme and plugin conflicts by following these instructions:

http://www.gravityhelp.com/documentation/page/Testing_for_a_Theme/Plugin_Conflict

Also, I haven't edit my functions.php in any way to affect gravity forms. It might be worth noting that I'm not using 2010 or 2011 as my base template however. I'm using Starkers Theme. I would assume there aren't any edits to that function.php file that would conflict with gravity forms but I guess I can't say definitively. I haven't added anything to it though.

@vokent, have you added any code to your functions.php for any sort of custom Gravity Forms functionality?

Can you submit that form from the Preview? That would help rule out a plugin or theme conflict. Navigate to the form, then click the preview link and see if you can submit from there.
