No, this is not something that is permitted with our licenses. You should not bundle or include Gravity Forms with your theme and your license cannot be distributed. This isn't just something we do not permit, but it's something that isn't a best practice when it comes to themes. Themes should not bundle plugins and should focus on the design of a site and leave plugins to the user to opt to install and/or purchase. What you could do if you wish is sign up for our affiliate program on our site and then promote Gravity Forms from your theme for users to purchase.
StudioPress does something like this with their Genesis theme, where there is a message on their form demos http://demo.studiopress.com/eleven40/contact/
