Does it show up this way in the preview mode? What version of Gravity Forms and WordPress do you have?
Yes, it shows that way in preview mode. We're using WordPress 3.4.1 and gravity forms Version 1.6.4.5.
Any additional help on this?
If you duplicate the form and embed that duplicate form, does the same thing happen?

Okay it turns out it was because I had a list in an HTML block on the form. Is there a way to make lists without it showing before its conditionally supposed to?
Yes. There is no restriction on using list items in your HTML block. Sounds like the HTML was invalid in some way?
Make sure you use single quotes and not double quotes in your html in the block if you were trying to add css classes or whatnot.
