Fatal error on activation of new install

  1. I am getting a duplicate declaration error on a new clean install:
Fatal error: Cannot redeclare gravity_form() (previously declared in /home/path/public_html/wp-content/plugins/gravityforms/gravityforms.php:5552) in /home/path/public_html/wp-content/plugins/gravityforms/gravityforms.php on line 5554

According to the settings section all is good.
    PHP Version 5.2.11
    MySQL Version 5.0.81
    WordPress Version 2.8.5
    Gravity Forms Version 1.2.2

I have tried disabling all plugins first, and then choosing this one and that still fails. As I said this is a 100% clean install of WP today, and this is the first thing that I am doing.

    Any ideas.
